1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 353, 351(2), 109 and 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that accused persons including the petitioner along with 4-5 unknown accused came and started abusing, on objection, Tiger pulled the informant out of the house and thereafter all the accused assaulted him by lathi and danda and when his wife came to save him, Tiger
Patna High Court CR. MISC. No.37688 of 2025(2) dt.18-06-2025 2/3 along with petitioner tore her cloth and abused. Further, when villagers gathered, the accused persons fled and Tiger fired 4-5 rounds in the air.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that thrust of the allegation is against Tiger and allegation against this petitioner of tearing the cloth of the wife of the informant has been alleged only with with a view to give seriousness to the case. It is reiterated and submitted that petitioner is a person with clean antecedent and it is also submitted that petitioner will not abscond rather will cooperate in the investigation.
5. Learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, abovenamed, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two
Patna High Court CR. MISC. No.37688 of 2025(2) dt.18-06-2025 3/3 sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P. S. Case No.292 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
