JUSTICE SUDHIR SINGH ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and learned counsel for the State Petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with other accused persons is said to have killed daughter of the informant.
Earlier bail application of the petitioner was rejected vide Annexure-1 to the present application. This is the second attempt on behalf of the petitioner for grant of bail. A report was called for from the trial court regarding stage of the case. It has been reported that prosecution evidence has been closed. Statement under Section 313 of the Code of Criminal Procedure has already been recorded. Trial is reported to be concluded within a period of three months. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. The trial court at Gopalganj is directed to conclude the trial in
Patna High Court Cr.Misc. No.34295 of 2016 (3) dt.07-09-2016 2/2 connection with Uchakagawn P. S. Case no. 57 of 2015 preferably within a period of three months from the date of receipt/production of a copy of this order.
The present application stands disposed of.
