The petitioner apprehends his arrest in Mallaypur P.S. Case No. 12 of 2014, registered for the offences punishable under Section 394 of the Indian Penal Code.
Three persons hired an auto and after assaulting the driver all the three fled away.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR. It transpires from para 62 of the case diary that the mobile is of one Sanjeet Kumar. The petitioner is friend of Sanjeet Kumar. It is a case of 394 of the Indian Penal Code and the police also issued notice to the petitioner to appear for interrogation but the petitioner did not appear before the
Patna High Court Cr.Misc. No.23225 of 2015 (2) dt.07-07-2015 police.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
