The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

The prosecution case, in short, is that on 17.02.2019 the informant had parked his motorcycle behind Durga Mandir, Ganj Bazar and had gone to purchase goods from kirana shop. In the meantime, unknown person had stolen away his motorcycle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.02.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated

Patna High Court CR. MISC. No.38269 of 2019(2) dt.25-06-2019 2/2 in the present case. From the half constructed house of the petitioner, stolen motorcycle is said to have been recovered. The petitioner had no knowledge regarding the same. It is submitted that the petitioner may be released on bail after completion of six months in custody from 20.02.2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of six months in custody from 20.02.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. case No.71 of 2019.
