2. The petitioner has preferred this application for grant of regular bail in connection with Muffasil P.S. Case No. 241 of 2023 dated 10.11.2023 registered for the offences punishable u/s 392 of the Indian Penal Code.

3. The prosecution case, in short, is that the informant submitted a written report to the S.H.O., Katihar Muffasil on 09.11.2023 in night, the petitioner along with two other co-accused persons are alleged to have entered the house of the informant and on the point of gun, they took away cash of Rs. 50,000/-, two mobile phones and some jewelleries from the house of the informant.

4. Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.44607 of 2024(2) dt.20-07-2024 2/2 the petitioner is innocent and has falsely been implicated in this case. No T.I.P. has been conducted by the prosecution. Nothing has been recovered from the conscious possession of the petitioner. The co-accused person has already been granted regular bail by this court vide order dated 29.04.2024 passed in Cr. Misc. No. 29626 of 2024. The charge-sheet has been submitted against the petitioner. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 03.01.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar in connection with Muffasil P.S. Case No. 241 of 2023.

7. The application stands allowed.
