JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The present case was lodged against unknown person but in course of investigation, it came to light that petitioner and some others were seen with the deceased prior to the alleged occurrence. The post mortem examination on dead body of the deceased was done and it was found that cause of death of the deceased was pressing of his neck. Moreover, except the aforesaid circumstance, there appears to be nothing against the
Patna High Court Cr.Misc. No.34249 of 2016 (2) dt.20-08-2016 2/2 petitioner and having similar allegation, co-accused, Munna Patel has already been granted privilege of bail by a co-ordinate Bench of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Praduman Kumar, Judicial Magistrate 1st Class, Motihari, East Champaran in connection with Muffasil P.S. Case No. 329 of 2015.
