This application for regular bail arises out of Belaganj P.S. Case No. 292 of 2020, disclosing offence punishable under Sections 147, 148, 149, 341, 323, 384, 504 and 506 of the Indian Penal Code.

The informant is driver of a Hyva truck. It is alleged that when he was driving the truck from Gaya to Patna it was overtook by a Tata Sumo vehicle. Allegedly, co-accused Karu Singh, Rishu Singh and Chhotu Singh with 5-6 unknown got down of the vehicle and demanded a sum of Rs. 50,000/- as extortion money. When resisted, they are said to have snatched a sum of Rs. 10,000/- from the pocket of the informant. In the meantime, the police came and arrested seven persons who were

Learned counsel appearing on behalf of the petitioner has argued that except for the fact that he was found sitting in the Sumo vehicle, there is absolutely no material against him. He has further submitted that no incriminating material has been recovered from the vehicle nor from the petitioner's possession. Considering the above submission and the fact that petitioner has no criminal antecedent, in my opinion, a case for grant of regular bail is made out. This application is accordingly allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Gaya, in Belaganj P.S. Case No. 292 of 2020.

It is directed that defects in the application pointed out by the Registry must be removed within two months from today. (Chakradhari Sharan Singh, J) Rajesh/- U T
