JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 47, 54, 57 and 34 of the Bihar Excise Amendment Act, 2016.
In huge quantity Indian made Foreign liquor was recovered from the house which belongs to Sunil Kumar, who happens to be brother-in-law of the petitioner. No doubt, petitioner was caught while he was fleeing from the aforesaid house but submission on behalf of the petitioner is that the petitioner had gone to meet his sister and moreover, the aforesaid house had already been given on rent to one Ashish Ranjan Tyagi, which is evident from Annexure-3 to
Patna High Court Cr.Misc. No.33786 of 2016 (2) dt.18-08-2016 2/2 the petition.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., (East), Muzaffarpur in connection with Mithanpura P.S. Case No.127 of 2016.
