JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 379 and 411 of the Indian Penal Code. Two persons were apprehended with stolen motorcycle and after that they disclosed that they used to sell the aforesaid stolen motorcycle to the petitioner who runs a garage and after the aforesaid disclosure, one stolen motorcycle was recovered from the garage of the petitioner but there is nothing in the impugned order to show that the petitioner was aware of this fact that the seized motorcycle was stolen property or not. Moreover, petitioner does not have any criminal antecedent and is

Patna High Court Cr.Misc. No.28974 of 2016 (2) dt.25-07-2016 2/2 languishing in jail custody since 18.5.2016.

Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Rohtas at Sasaram in connection with Sasaram (Model) P.S. Case No.566 of 2016.
