JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be father-in-law of the deceased and is languishing in jail custody since 25.06.2015 and the entire allegation of torturing the deceased centers around the petitioner. Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 14.07.2016 passed in Cr. Misc. No. 24015 of 2016 and, again, I am not inclined to release the petitioner on bail on the ground mentioned by me in my previous order. Accordingly, his prayer for bail in connection with Udawant Nagar P.S.Case No. 165 of 2015, pending in the court of chief Judicial Magistrate, Bhojpur at Ara, stands rejected. However, the learned Chief Judicial Magistrate,
Patna High Court Cr.Misc. No.6206 of 2017 (3) dt.29-03-2017 2/2 Bhojpur at Ara is directed to commit the case of the petitioner to the court of sessions in accordance with law without any delay and, thereafter, the concerned sessions court should expedite the trial of the petitioner and try to conclude the same as early as possible.
