The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act.

16.92 liters of foreign liquor has been recovered from a motorcycle, of which, this petitioner is registered owner. It is submitted on behalf of petitioner that nothing has been recovered from the possession of this petitioner. Though, petitioner is registered owner of the motorcycle, from which, illicit liquor has been recovered, but the same was being used by someone else without his knowledge or consent. However, learned A.P.P. for the State vehemently

Patna High Court CR. MISC. No.39809 of 2022(2) dt.23-09-2022 2/2 opposed the prayer for bail and submitted that illicit liquor has been recovered from the motorcycle, of which, this petitioner is registered owner and petitioner cannot escape from his liability. Considering the same, the prayer for anticipatory bail of petitioner is rejected.
