The petitioner seeks bail in connection with Nawada (Town) P.S. Case No.597 of 2016 registered under Sections 272 and 273 of the Indian Penal Code besides Sections 47(A)(C)(E)(G) of the Bihar Excise (Amendment) Act, 2016.

The accusation is that on receiving secret information about storing of illicit liquor in the semi constructed house by Sheru Singh and this petitioner at village-Gopal Nagar, police reached at village-Gopal Nagar and raided the semi constructed house, situated adjacent to the house of Dealer Ramraj Prasad, and recovered 458 bottles, each containing 750 ml. Indian Made Foreign Liquor, and 11 bottles, each containing 375 ml. Indian Made Foreign Liquor,

Patna High Court Cr.Misc. No.3391 of 2017 (2) dt.10-02-2017 2/2 from there. In that course, police also raided the house of Sheru Singh and recovered a damaged cartoon and one empty bottle of Indian Made Foreign Liquor from there but neither Sheru Singh nor this petitioner was found present there.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that nothing was recovered either from the conscious possession or the house of the petitioner. The petitioner has falsely been implicated in this case on mere suspicion. The petitioner is in custody since 09.11.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrater, Nawada, in connection with Nawada (Town) P.S. Case No.597 of 2016.
