A dispute arose over disconnection of electricity line and in the aforesaid back ground, it has been alleged by the informant that appellants have assaulted and abused him by calling his caste name, which was done by the other co-accused and then thereafter, they had assaulted him with lathi and danda. Further more, appellant had brought a sword from his house and tried to inflict a sword blow, where upon the informant indulged to grab the weapon and during course thereof, the appellant has himself sustained injury by means of sword on his hand and jaw. The appellant is in custody since 16.12.2016.

Patna High Court CR. APP (SJ) No.571 of 2017 (2) dt.11-04-2017 2/2 Accordingly, setting aside the order dated 12.01.2017 passed by the learned Special Judge, SC/ST Act, Aurangabad in B.P. No. 71 of 2017, appellant, Arimardan Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- VII, Aurangabad, in connection with Kutumba P. S. Case No. 121 of 2016).

Consequent thereupon, the instant appeal is allowed. (Aditya Kumar Trivedi, J) Sudha/- U T
