JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-06-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code and 27 of the Arms Act. Earlier the bail prayer of the petitioner was rejected by this court taking note of seriousness of the alleged offence but submission on behalf of the petitioner is that petitioner is in jail custody since 16.07.2016 and as a matter of fact, no specific overt act has been attributed against the petitioner. The learned trial court has reported that case of the petitioner is still pending for appearance.

Patna High Court Cr.Misc. No.18288 of 2018 (5) dt.27-06-2018 2/2 The report of trial court goes to show that there is no likelihood of conclusion of trial of the petitioner in near future. Para 3 of the petition goes to show that petitioner does have criminal antecedent of two cases besides the present one. Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Shiv Kumar Sharma, learned Judicial Magistrate 1st Class cum A.M. IIIrd, Araria in connection with Raniganj P.S. Case No. 146 of 2015, subject to condition that one of the sureties must be close relative of the petitioner, who shall swear an affidavit before the concerned court to this effect as to how is he/she related with the petitioner.
