The petitioner seeks bail in Madhepura (Bharrahi) P.S. case No. 127 of 2016, corresponding to Sessions Trial No. 148 of 2016, under Section 366A, 34 of the Indian Penal Code. The informant alleged that petitioner and others kidnapped his daughter.

The learned counsel for the petitioner submits that the victim was recovered and she herself disclosed that petitioner and Mantu forcibly kidnapped her from a maize field and petitioner solemnized marriage with her. The victim disclosed that petitioner did not physically exploit her nor subjected her to any sorts of torture. It is submitted that victim voluntarily solemnized

Patna High Court Cr.Misc. No.18750 of 2017 (3) dt.10-05-2017 2/2 marriage with the petitioner. The doctor assessed the age of victim between 16-18 years.

Considering the facts aforesaid and the fact that victim herself disclosed that she was not subjected to any physical exploitation, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Madhepura, in S.T. No. 148 of 2016, arising out of Madhepura (Bharrahi) P.S. Case No. 127 of 2016.
