The petitioner is accused in connection with Hajipur Town P.S. Case No. 760 of 2016, registered under Sections 188, 420 and 120(B) of the Indian Penal Code and Sections 30, 47, 48 and 38 of the Bihar Excise Amendment Act, 2016. Learned counsel for the petitioner submits that though there is allegation of recovery of huge quantity of India made foreign liquor to the Truck bearing Reg. No. HR-38V0853, which was being driven by Narendra Kumar Sharma, but the petitioner was not apprehended to the truck, rather, he is said to be apprehended in fleeing condition and he has been implicated in this case showing that he is also involved in the
Patna High Court Cr.Misc. No.7365 of 2017 (2) dt.22-03-2017 2/2 business of carrying liquor through the said truck. Further submission is that petitioner has no criminal antecedent is in custody since 03.11.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S.
