Heard learned counsel for the petitioner as well as learned APP for the State.

In this case, the petitioner is seeking regular bail in connection with Kargahar P.S. Case No. 174 of 2022, registered for the offences punishable under Sections 376/511 of the Indian Penal Code and 4 of the POCSO Act.

As per allegation, the petitioner attempted to commit rape upon the minor daughter of the informant. The learned counsel for the petitioner has submitted that the petitioner is an old person and has falsely been

A report was called for from the court below about the stage of trial. The report has come. It has been mentioned in the report that all the witnesses except the doctor have been examined.

It appears that during her examination, the victim has supported the occurrence and trial is on the verge of conclusion. The bail petition is presently rejected with the observation that if the trial is not concluded within a period of 3 months, the petitioner may renew his prayer for bail. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned herein above, failing which, the matter shall be brought to the notice of this Court.
