JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Tr.No.1140/16 (Majhaulia P.S.Case No.19/16) arising out of Complaint Case No.17 ( C ) / 2016 registered for the offence under Sections 498(A), 302, 201 and 120(B) of Indian Penal Code. It has been submitted that the petitioner is brother of the Nandoi of the deceased who is in jail custody since 18.09.2016.

From the complaint petition which was sent to P.S. it appears that there is general and omnibus allegation against the petitioner. It has been stated that the mother-in-law of the deceased, Rukhshana Khatoon, has already been granted bail vide

Patna High Court Cr.Misc. No.8706 of 2017 (2) dt.10-03-2017 2/2 Cr.Misc. No.45961 of 2916 on 22.11.2016.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri S.D.Bharti, J.M. 1st Class, Bettiah, West Champaran, in Majhauliya P.S.Case No.19/16 arising out of Tr.No.1140/16, Complaint Case No.17 (C )/16, subject to the condition that both bailers shall be the close relative of the petitioner.
