The petitioner is in judicial custody in connection with Dhamdaha P.S. Case No.174 of 2021 instituted under Sections 302, 304B, 498A/34 of the IPC.

As per the prosecution story the victim lady was married to the petitioner herein but was regularly tortured for want of dowry and on the fateful day it is alleged that she was killed by the husband and his family members. Taking into account the fact that the petitioner is the husband and had the responsibility to protect the lady who is now dead, this Court is not inclined to grant him privilege of
