The petitioner apprehends his arrest in a case under Section 406 and other sections of the Indian Penal Code. The police raided Bettiah bus stand and apprehended Mahesh Kumar and Abhimanyu from whose possession lottery tickets were recovered. The said accused Mahesh Kumar disclosed the name of this petitioner.
It is submitted that petitioner did not run the lottery shop.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of his arrest or surrender before the
Patna High Court Cr.Misc. No.23495 of 2015 (2) dt.09-07-2015 2/2 learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah in Bettiah Town P.S. Case No. 131 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
