JUSTICE SANJAY PRIYA ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Pachrukhi P.S. Case No. 30 of 2017, instituted for the offence under Section(s) 457, 380 of the Indian Penal Code.

It has been submitted that name of this petitioner has been taken by co-accused Sahi Noor in his confessional statement. The petitioner came to India on the basis of valid VISA for the period started from 05.11.2015 to 04.05.2016 and he was arrested on 13.01.2016 merely on the basis of confessional statement of co-accused. Moreover, there is no recovery of any incriminating article from the possession of the petitioner.

Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of 4th Additional Sessions Judge, Siwan in connection with Sessions Trial No. 30 of 2017, arising out of Pachrukhi P.S. Case No. 293 of 2015, subject to the conditions that both the bailors shall be the close relative of the petitioner.
