JUSTICE SUDHIR SINGH ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.
Allegation is that some accused persons looted away cash, laptop, mobile etc. from different persons. Petitioner has been involved in the present case on the basis of confessional statement of the co-accused.
It has been submitted on behalf of the petitioner that he is in custody since 13.1.2016. Chargesheet has been submitted against the petitioner. Petitioner is not named in the F.I.R. He has not been put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioner. He has been made accused on the basis of confessional statement of the co-accused. Other co-accused have been granted bail vide Cr. Misc. no. 3032 of 2016 and Cr. Misc. no. 57838 of 2015.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.25381 of 2016 (4) dt.09-08-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul ( Lakhisarai) , in connection with Jamalpur Rail (Jamalpur G.R.P.) P.S. Case no. 26 of 2015.
