JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code and Section 25 (1-B)a, 26, 35 of the Arms Act. One country made pistol, containing five live cartridges and mobile sets etc. were recovered from the conscious possession of the petitioner and after that, on the basis of confessional statement of the petitioner, one stolen motorcycle as well as stolen pump set are recovered from the house of the petitioner. The petitioner is in jail custody since 23.03.2016. Submission made on behalf of the petitioner is that the pump set was of the petitioner and as a matter of fact, the agnate of

No.30710 of 2016 (2) dt.08-08-2016 2/2 the petitioner lodged a case for theft of the aforesaid pump set and other articles and except the present case as well as one another, the petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Siwan in connection with Daraunda P.S. Case No. 45 of 2016.
