JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-12-2013 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner apprehends arrest in a case registered for the offences punishable under sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code and section 27 of the Arms Act.

It has been stated in paragraph 3 of the application that the petitioner has no criminal antecedent. Learned counsel for the petitioner submits that even as per the first information report no offence under section 27 of the Arms Act is made out against this petitioner. He further submits that as per the prosecution story the petitioner assaulted the informant with iron rod and also snatched a golden chain worth Rs. 45,000/- from the informant's

Learned counsel for the petitioner submits, referring to the injury report, that the injury falsifies the prosecution case and the injury has been found to be simple in nature. He submits that it is highly improbable that the petitioner, in the facts and circumstances alleged, would snatch golden chain. Considering the submission as above and the facts and circumstances in which the case came to be instituted as also the submission that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today be released on bail on his furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Bidupur P.S. case No. 149/2013, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
