The present petition has been filed with a prayer to restore Cr. Misc. No. 3947 of 2010, which stood dismissed due to non -compliance of peremptory order dated 23.7.2012. By the said order one week peremptory time was granted to learned counsel for the petitioners to implead the person, who was first party in the proceeding before the learned Sub Divisional Magistrate, Manjhaul. Since the order was not complied with in time, the petition stood dismissed.

In view of the facts and circumstances, the petition stands allowed.

Cr. Misc. No. 3947 of 2010 is directed to be restored to its original file with an indication that if the order dated 23.7.2012 passed in Cr. Misc. No. 3947 of 2010 is not complied within a
