JUSTICE SUDHIR SINGH ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 147, 148, 149,341, 323,307,302 and 504 of the Indian Penal Code.

The prosecution case, in brief, is that the informant's wife Gouri Devi was cleaning her room then informant's brother Raben Yadav assaulted her by Debiya and thereafter petitioner and others assaulted her and when informant came to save his wife, he was also assaulted. During treatment informant's wife died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.04.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses

Patna High Court Cr.Misc. No.35618 of 2016 (3) dt.25-10-2016 2/2 alleged against the petitioner. Both the parties are agnates. The main allegation is against Raben Yadav, who gave fatal injury on the deceased. As far petitioner is concerned, general and omnibus allegation has been made against him.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura in connection with Murlianj P.S.Case No. 110 of 2016.
