This application is for grant of bail in connection with Kudra P.S.Case No.301 of 2016 for the offence under Sections 384/397 of the Indian Penal Code.

It is submitted on behalf of the petitioner that he is not named in the F.I.R. but later on, on the basis of confessional statement of the other co-accused persons, he has been arrested in this case and he is in custody for about two months. Heard learned A.P.P. also.

Having heard both sides. From perusal of the impugned order, it appears that the Mobile, which was used in the extortion demand, has been recovered from the possession of the petitioner, as such, at this stage, I am not inclined to grant bail to the

Patna High Court Cr.Misc. No.5387 of 2017 (3) dt.21-02-2017 2/2 petitioner, however, the petitioner is at liberty to renew his prayer for bail after framing of the charge in this case and the learned court below, considering the entire aspects of the matter, will pass an appropriate order without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
