JUSTICE BIRENDRA KUMAR ORAL ORDER 08-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 364/120B/34 of the Indian Penal Code. Later on, offences under Sections 302/201 of the Indian Penal Code were added.
According to FIR, the named person took the husband of the informant on the pretext of watering the field. Thereafter, dead body of the husband of the informant was found and it was noticed that murder has been committed. Petitioner is not named in the FIR.
Submission is that there is no other materials against the petitioner save and except suspicion. There is no

No.15948 of 2018 (3) dt.08-05-2018 P2/ eyewitness of the occurrence Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Charpokhari P.S. Case No.257 of 2015, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
