JUSTICE SATYAVRAT VERMA ORAL ORDER 27-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Shambhuganj P.S. Case No. 21 of 2021 instituted for the offences under Sections 25(1-b)a and 26 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 22.01.2021, charge-sheet has been submitted and has antecedent of six cases as mentioned in para 3 of the bail application.

Allegation in the FIR is of recovery of one country made loaded pistol along with one live cartridge from the petitioner.

No.49424 of 2021(2) dt.27-01-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated based on his antecedent when nothing was recovered from possession of the petitioner. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in this case, let the petitioner above named be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 21 of 2021, with condition that one of the bailors shall be the brother-in-law of the petitioner, namely, Pawan Kumar Singh and further if the petitioner gets implicated in a case of similar nature, the present bail bonds will be cancelled by the learned court below, if the same comes to its notice.
