The petitioner seeks regular bail in registered for the offences punishable under section 376 and other allied sections of the Indian Penal Code and sections 4/6 of the POCSO Act. It is alleged that the petitioner committed rape on the minor daughter of the informant as a result of which she committed suicide by setting herself on fire. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case because of previous enmity. He submits that the deceased committed suicide because of depression. He further submits that co-accused Raju Das had kidnapped sister of the deceased and other accused persons were passing comments on the
Patna High Court CR. MISC. No.49300 of 2021(3) dt.18-04-2022 2/2 deceased which compelled her to commit suicide. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 24.2.2021.
Learned counsel for the State and the informant oppose the prayer for bail and submits that there is direct and specific allegation against the petitioner that he committed rape on the minor daughter of the informant as a result of which she committed suicide. Post mortem report also supports the prosecution case.
Considering the nature of accusation and materials available on the records against the petitioner, his prayer for bail is refused.
