ANJANA MISHRA ORAL ORDER 04-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 24.11.2017 in connection with Amnour P.S. Case No. 97/2017 registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that though he is not named in the First Information Report, subsequently, in the confessional statement made before the police, which has no evidentiary value, the petitioner is facing prosecution. Learned counsel for the petitioner submits that save and except such confessional statement, there is no further material in the case diary to implicate this petitioner in connection with the present case. As such, he may be released on bail.

Patna High Court Cr.Misc. No.20427 of 2018 (3) dt.04-05-2018 Diary in the present case was called for which has since been received.

Learned counsel appearing on behalf of the State after perusal of the case diary submits that apart from the confessional statement made before the police, there is no further material in the case diary.

Considering the aforementioned facts and circumstances and that the petitioner has already been in custody since 24.11.2017, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Amnour P.S. Case No. 97/2017.
