The petitioner seeks bail in Ahiyapur P.S. case No. 22 of 2017 under Section 356, 379/34 of the Indian Penal Code. The informant alleged that while he was returning to his house, the miscreants, aged about 20 years, snatched Rs. 10,000/- from his possession and fled away. The informant further alleged that after some time he got information that Mira Devi, wife of Shambhu Mahto, was returning to her house, having Rs. 70,000/- in her possession, but she was also robbed. The informant went there and identified the petitioner as the person who had snatched his money.

The learned counsel for the petitioner submits that the informant did not lodge the case immediately after the

Patna High Court Cr.Misc. No.20521 of 2017 (2) dt.04-05-2017 2/2 occurrence. The petitioner was apprehended, on chase, while he was fleeing away after snatching money from Mira Devi. The informant identified him but nothing has been recovered from the possession of the petitioner.

Considering the facts that informant did not lodge the case immediately after the occurrence, he simply identified the petitioner when the petitioner was apprehended, on chase, while he was fleeing away after snatching money from the possession of Mira Devi, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Ahiyapur P.S. Case No. 22 of 2017 (G.R. No. 144 of 2017).
