Heard.

Petitioners and other FIR named accused are said to have assaulted the informant and others and in that course petitioners are said to have given rod and khanti blows to deceased Lalo Devi. The postmortem report goes to show that she sustained one injury on her head.

Submission on behalf of the petitioners is that there is a case and counter case between the parties and as a mater of fact, it was the prosecution party who assaulted the petitioners and after the occurrence petitioner no.2 lodged Laukaha P.S.Case

Patna High Court Cr.Misc. No.30081 of 2016 (4) dt.18-10-2016 2/2 No.25 of 2016 which is evident from Annexure-3 to the supplementary affidavit.

Petitioners are in jail custody since 25.03.2016 and the investigation against them has already been completed. Considering the aforesaid facts and circumstances as well as the submission of the parties, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Jhanjharpur in connection with Laukaha P.S.Case No.24 of 2016.
