The petitioner seeks bail in a case instituted for the offence under Section 395 of the Indian Penal Code. It has been submitted that one co-accused was apprehended by the police who disclosed his name as Bijendra Mehta @ Digga Mehta. He stated before the police that this petitioner and other accused as named by him have managed to run away.

It has been submitted on behalf of the petitioner that no incriminating article has been recovered from possession of this petitioner. He is not named in the First Information Report. No T.I.P. has been held in this case till date. He is in custody since

No.4492 of 2017 (2) dt.13-02-2017 2/2 28.10.2016 Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Uda-Kishunganj, Madhepura, in connection with Puraini P.S. Case No. 65 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner.
