2. This application for anticipatory bail arises out of Marhaura P.S. Case No. 551 of 2024 for the offences punishable under Sections 323, 341, 366, 363, 364, 498 and 497 of the I.P.C.

3. As per the allegation, petitioner along with coaccused persons had kidnapped the married daughter of the informant and had kept her in hibernation, when the informant went to the house of co-accused Akash Kumar, she was abused and then stated that co-accused Akash Kumar has kidnapped the daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner has submitted

No.38479 of 2026(3) dt.23-07-2026 2/3 that the date of alleged occurrence is stated to be 16.05.2024 while the complaint case came to be filed on 08.08.2024, whereafter the said complaint was sent to the police under the provisions of 156(3) of the Cr.P.C. for registration of the F.I.R. It has further been submitted that the petitioner is sister-in-law (Bhabhi) of co-accused Akash Kumar. It has further been submitted that co-accused Akash Kumar happens to be the uncle of the victim. It has further been submitted referring to the statement of the victim recorded under Section 183 B.N.S.S. which was earlier called for by order dated 17.06.

2026 that petitioner along with co-accused Akash Kumar had come to the matrimonial house of the victim and thereafter, they went to Chapra railway station, while the petitioner left their company and Akash Kumar took her to Delhi, where the said co-accused Akash Kumar forcibly established physical relationship with the victim and also retained her ornaments. It has further been submitted that actually the victim and co-accused Akash Kumar were in love and were willfully living together. It has lastly been submitted that the petitioner is a lady and has got no criminal antecedent.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioner.

6. Heard the parties and perused the record. Considering the facts and circumstances as well as nature of material against the petitioner, let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Marhaura P.S. Case No. 551 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
