The petitioner, already in custody, seeks bail in connection with Excise Case No. 16 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is that 33 litres of toddy were recovered from the hut where he was selling the same. Learned counsel for the petitioner submits that the said hut is not of the petitioner and only excise constables are the seizure list witnesses and the petitioner has been in custody since 11.01.2017 having no criminal antecedent.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.11399 of 2017 (2) dt.15-03-2017 2/2 circumstances, the petitioner, namely, Manish Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Excise Case No. 16 of 2017.
