Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 35 & 26 of the Arms Act.

According to FIR, the police received information that two groups were fighting against each other and were resorting to firing also. The petitioner and co-accused Karu Mahto were apprehended by the police at the spot. From the possession of the petitioner, a pistol was recovered without any cartridge and same recovery was from Karu Mahton who has already been allowed bail by a Coordinate Bench of this Court vide order dated 09.04.2018 passed in Cr. Misc. No. 20786 of 2018.

Patna High Court Cr.Misc. No.12922 of 2018 (3) dt.25-04-2018 2/2 Considering the nature of allegation, let the petitioner, above named, be released on bail on completion of nine months of custody on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barauni Police Station Case No. 451 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
