The petitioner is in custody in connection with Dulhin Bajar P.S. Case No. 102 of 2019 (Special Case No. 4047 of 2019) for the offenses under Section 37(b)(c) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Allegation against the petitioner is that on consumption of liquor he abused informant. There was a positive result in the Breath Analyzer Test. The petitioner is in custody since 18.04.2019.

Considering the fact that the petitioner has no criminal antecedent and the allegation is that he has consumed liquor, the Court is inclined to grant him bail. Let the petitioner, above

Patna High Court CR. MISC. No.40291 of 2019(2) dt.01-07-2019 2/2 named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna, in connection with Dulhin Bajar P.S. Case No. 102 of 2019.
