The petitioner is languishing in custody in a case registered for the offences punishable under Sections 392, 394, 379, 307 of the Indian Penal Code and Section 27 of the Arms Act.

It is a case of demanding money on pistol point and snatching the mobile of the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and his name subsequently sprang up on the

Patna High Court CR. MISC. No.40624 of 2023(2) dt.14-07-2023 2/2 confessional statement of co-accused Dhiraj Kumar who has been granted bail by a coordinate Bench of this Court vide order dated 06.07.2022 passed in Cr. Misc. No. 6477 of 2022. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 25.02.2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 14th Additional Sessions Judge, Motihari, East Champaran/concerned court in connection with Dumaria Ghat P.S. Case No. 44 of 2021.
