JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-09-2015 One Janardan Prasad Rai, the husband of the petitioner was allotted PDS licence being Licence No.4 of 2001. He was murdered by nexalite on 6.1.2006 giving rise to Konch P.S. Case No.01/2006 dated 6.1.2006. A copy of the F,I,R, is at Annexure2. The petitioner submits that after death of her husband, she applied in terms of clause 2.5 of the 2001 Order which provides for compassionate appointment.

It appears from the order dated 8.8.2008 passed by the SubDivisional Officer, Tekari that the application of the petitioner was earlier rejected by the District Selection Committee on

Patna High Court CWJC No.20624 of 2014 (2) dt.22-09-2015 23.7.2007.

The petitioner raised a grievance that a copy of the rejection order was not ever made available to her so that she could file an appeal against the said order before the Appellate Authority. Having regard to the facts that the husband of the petitioner was killed by the nexalite and at that time he was under 55 years of age, the Appellate Authority would duly consider her case for grant of licence on compassionate ground if she files an appeal within two months from today annexing a copy of order dated 8.8.2008, as contained in Annexure-5 to the writ petition. With the aforesaid observations and directions, this writ application stands disposed of.
