JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the informant himself, co-accused Md. Abdullah was owner whereas co-accused Nizam Ali was driver of the truck in question and petitioner was seen by him in company of the aforesaid two co-accused persons. Moreover, co-accused Md. Abdullah has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 08.09.2019 passed in Cr. Misc. No. 31046 of 2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.40669 of 2016 (3) dt.03-10-2016 2/2 two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur in connection with Bahera P.S.Case No. 103 of 2016.
