JUSTICE BIRENDRA KUMAR ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is a case of misuse of privilege of bail in a case registered for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner did not appear after cognizance for the reason, as submitted by learned counsel for the petitioner, that no summons was ever served to the petitioner and he was doing work of labour in some other State.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.8293 of 2017 (2) dt.21-02-2017 2/2 amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hilsa, Nalanda/Successor Court in connection with Islampur P.S. Case No. 26 of 2000, subject to the condition that petitioner shall fully cooperate with the trial of the case, failing which learned Court below shall be at liberty to cancel the bail bonds of the petitioner.
