The petitioner seeks bail in Supplementary Mansi P.S. Case No. 273 of 2019, registered for the offence under Section 302 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of petitioner that as per F.I.R. itself, other co-accused persons are alleged to have fired at the deceased and caused death of brother of the informant. So far as this petitioner is concerned, he is alleged to have caused firearm injury to Abdul Salam, who in his statement has stated that he received injury at the hand of co-accused Sachidanand Yadav. It is further submitted that other five similarly situated coaccused persons have already been granted bail by this Court, vide order dated 26.08.2020 passed in 19788 of 2020 and order dated 10.03.2021 passed in Cr.Misc. No. 17 of 2021

Patna High Court CR. MISC. No.49509 of 2021(2) dt.24-11-2021 2/2 respectively (Annexure 3 & 4 respectively). Petitioner is in custody since 10.04.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Supplementary Mansi P.S. Case No. 273 of 2019.
