The petitioner seeks bail in Bidupur P.S. case No. 220 of 2016 under Section 394 of the Indian Penal Code. The informant, Girendra Kumar, alleged that six persons on two motor cycles came to his petrol pump and asked his nozzle man to fill petrol in their motor cycles. The criminals asked the informant to open the counter but, on refusal, they looted away Rs. 48,600/- from the possession of nozzle man. The learned counsel for the petitioner submits that petitioner is not named in the FIR. For the first time, the name of the petitioner figured in the case in the confessional statement of Chandan Kumar, who was arrested along with Rahul Kumar in
Patna High Court Cr.Misc. No.10010 of 2017 (3) dt.24-03-2017 2/2 connection with Mahua P.S. case No. 286 of 2016. Chandan Kumar disclosed that petitioner also committed dacoity in petrol pump along with him thereafter the police apprehended the petitioner and recovered Rs. 10,000/-. It is submitted that money was not put on T. I. parade nor the petitioner was put on T. I. parade. The petitioner is in jail since 19.08.2016. The petitioner has already remained in jail for seven months but till date he has not been put on T. I. parade.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Bidupur P.S. Case No. 220 of 2016. (Prabhat Kumar Jha, J) BKS/- U T
