The petitioner apprehends her arrest in a case under Section 307 and other sections of the Indian Penal Code. The informant named the petitioner along with his family members, namely, Devendra Singh, Ashok Singh, Pappi Kumari, Sanjeev Kumar Singh and alleged that they all came and set her house ablaze. It is submitted that there was a land encroachment proceeding between the parties. The encroachment was being removed by the order of the Court. The informant and his family members were not removing the encroachment and, that is why, they themselves set ablaze their house and falsely implicated the petitioner and her family members. It is submitted that the other accused persons have already been granted anticipatory bail vide order passed in Cr. Misc. No. 39457/2014.

Patna High Court Cr.Misc. No.24933 of 2015 (2) dt.14-07-2015 2/2 The case of the petitioner stands the same footing. There appears that the petitioner is also named along with other accused persons. Similarly situated accused persons have already been enlarged on anticipatory bail. Considering the facts aforesaid, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, West, Muzaffarpur in Kurhani P.S. Case No. 362/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
