JUSTICE SUDHIR SINGH ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 152, 341, 323, 504, 506, 332, 337, 307,353, 379 and 411 of the Indian Penal Code. Informant, a police officer, along with armed forces had gone to village Mohabatpur and seized wine during the course of illegal sale, upon which villagers started brick-batting and assaulting the police party. In the meantime, petitioner snatched rifle from one of the constables.

It has been submitted on behalf of the petitioner that he is in custody since 14.5.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Altogether nineteen persons are named in F.I.R. No specific injury has been attributed against petitioner. General and omnibus allegation has been made. Other co-accused has been granted bail vide Cr. Misc. no. 22096 of 2016.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.33478 of 2016 (3) dt.26-09-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Shekhopur Sarai P.S. Case no. 21 of 2016.
