1. The State of Bihar .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Sanjay Parasmani, Adv. For the Opposite Party : Mr. Shailendra Kumar -1, APP 60 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of regular bail for offence under Section 392 of the Indian Penal Code. Petitioner was apprehended at the spot when the petitioner and others had initially given lift on the vehicle to the informant as passenger and, thereafter, three persons, including the driver, who were sitting in the vehicle allegedly by putting the informant in fear of death robbed him. The petitioner is in custody since 21.06.2016.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail for the present.
The prayer for bail is refused.
However, the learned trial Judge is directed to conclude the trial within nine months, failing which the petitioner may renew his prayer for bail before the Court below itself.
