JUSTICE SUDHIR SINGH ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 394 of the Indian Penal Code.

It is alleged by the informant, Manager of Jayanti Petrol Pump, that four miscreants looted total Rs. 28,000/- from Sanajay Yadav, Nozzle man of the pump, tea vendor and from the cash counter at the point of pistol and assaulted the informant and one Rajendra Yadav.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.05.2016. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the FIR. On the basis of secret information the

Patna High Court Cr.Misc. No.35731 of 2016 (3) dt.25-10-2016 2/2 petitioner was arrested. He was put on T.I. parade but none of the witnesses has identified the petitioner in course of T.I. parade. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Balia P.S.Case No. 96 of 2016.
