The petitioner has preferred this application for grant of regular bail in a case registered under sections 307 and 120B of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, the accused persons with mask over their faces fired on the informant with the intention to kill. The informant sustained gun shot injuries. It is stated by the informant that he is convinced that the accused Randhir Kumar has a hand in the occurrence.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. His name transpired in course of investigation on the confessional statement of coaccused Randhir Kumar made before police and the said

Patna High Court CR. MISC. No.49219 of 2021(3) dt.24-03-2022 2/2 Randhir Kumar has already been enlarged on bail. It is further submitted that the said Randhir Kumar also took the name of accused Chandan Kumar who has also been enlarged on bail vide order dated 13.8.2021 passed in Cr. Misc. 30259 of 2021. The petitioner is in custody since 17.12.2020. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to co-accused Randhir Kumar on whose confessional statement the name of the petitioner transpired and the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Hajipur Sadar P.S. Case no. 641 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
