The petitioner Surendra Kumar Sharma apprehends his arrest in Buxar (Town) P.S. Case no. 24/14, registered for the offences punishable under Sections 420, 406 of the Indian Penal Code.

The informant made allegation that Ravi Prakash Sharma and the petitioner persuaded her to invest money in share market through Anand Rathi Share and Stock brokers Ltd., the office of which is running in the house of the petitioner Surendra Kumar Sharma. The informant further alleged that she invested a sum of Rs. 12,000,00/-. Ravi Prakash Sharma also gave her bond but thereafter the accused persons Ravi Prakash Sharma and the petitioner fled away and did not make payment.

The informant invested Rs. 3,000,00/- in the share market. The informant got Rs. 76,511/-. The informant also sold her share to another brokers of Dhanbad. The petitioner did not misappropriate even a single penny nor cheated the informant. The petitioner has not given any undertaking or acceptance of receiving of money from the informant. It was Ravi Prakash Sharma who had acknowledged the receipt of Rs. 12,000,00/- from the informant.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No. 24/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
